本条例乃有关提货单事宜。

1.简称

本条例定名为提单条例。

2.收货人或提货单受让人根据提货单所享权益

提货单上所列之每名收货人,以及提货单之每名受让人,由于提货单所述货物物权已转归该人所有之故,或由于该项托运或背书转让之故,应已承受及获得对该批货物之一切诉讼权,并应承担与该批货物有关之相同责任,一如该提货单内载之合约为其所签署者然。

3.有关中途停止运送或运费索偿之保留条款

本条例之规定不得妨碍或影响任何中途停止运送之任何权利,或向原托运人或货物物主索偿运费之任何权利,或收货人或提货单受让人由于或基于其身为收货人或提货单受让人之故所须承担之任何责任,或收货人或提货单受让人由于或基于该项托运或背书转让之故所收取货物之任何责任。

4.持有提货单之收货人等及针对船长之货物装运证据

收货人或提货单受让人以有价约因取得之提货单而该提货单乃代表已装船运载之货物者,该提货单应成为针对在该单上签名之船长或其他人士有关该批货物装运之确实证据,纵使该批货物或部分货物并未装船运载,除非该提货单持有人收取提货单时事实上已获通知,知悉有关货物其实并未有装船:

但在提货单上签名之船长或其他人士如证明该项虚伪陈述完全出于托运人或该提货单持有人或该持有人所要求索偿之人之欺诈行为,而非因其职责上之疏忽所致,则可免除责任。

1. Short title

This Ordinance may be cited as the Bills of Lading Ordinance.[Amended 5 of 1924 s. 6]

2. Rights under bill of lading to vest in consignee or indorsee

Every consignee of goods named in a bill of lading, and every indorsee ofa bill of lading, to whom the property in the goods therein mentionedpasses upon or by reason of such consignment or indorsement, shall havetransferred to and vested in him all rights of suit, and be subject to thesame liabilities, in respect of such goods as if the contract contained inthe bill of lading had been made with himself. 3. Saving as to stoppage in transitu or claims for freight

Nothing in this Ordinance shall prejudice or affect any right of stoppagein transitu, or any right to claim freight against the original shipper orowner, or any liability of the consignee or indorsee by reason or inconsequence of his being such consignee or indorsee, or of his receipt ofthegoods by reason or in consequence of such consignment or indorsement.[cf. 1855 c. 111 s. 2 U. 4. Bill of lading in hands of consignee, etc., evidence of ship- ment as against master

Every bill of lading in the hands of a consignee or indorsee for valuableconsideration representing goods to have been shipped on board a vesselshall be conclusive evidence of such shipment as against the master orother person signing the same, notwithstanding that such goods or somepart thereof may not have been so shipped, unless such holder of the billof lading has had actual notice at the time of receiving the same that thegoods had not been in fact laden on board: Provided that the master orother person so signing may exonerate himself in respect of suchmisrepresentation by showing that it was caused without any default on hispart, and wholly by the fraud of the shipper, or of the holder, or of someperson under whom the holder claims.[cf. 1855 c. 111 s. 3 U.
