本条例旨在综合及修订有关专利权注册之法例。

全文

1.简称

本条例定名为专利权注册条例。

2.释义

在本条例内,除上下文另具意义者外,下开各词应解释如下——

“局长”指英国专利权、设计及商标局局长;

“欧洲(英国)专利权”指根据欧洲专利权颁发公约所颁发之专利权,且标明在英国者;

“专利权”指根据1949年《专利权法》或1977年《专利权法》所颁发之专利权,亦指根据1977年《专利权法》第77条,在英国生效之欧洲(英国)专利权;

“优先日期”有下列各解释——

(a)就根据1949年《专利权法》所颁发之专利权而言,按该法第5条解释;

(b)就根据1977年《专利权法》所颁发之专利权而言,按该法第5条解释;及

(c)就欧洲(英国)专利权而言,按1977年《专利权法》第5条解释,但须受该法第78条所述之附带条件及修订所规限;

“处长”指总督任命的专利权注册处处长。

3.申请注册专利权

(1)任何获得专利权人,或任何经转让、遗赠或其他法例运用而从该专利权持有人处取得权利之人士,可于专利权颁发日期起首5年内,申请在香港注册该专利权。若只是部分转让或遗赠,则所有适当当事人得共同申请注册。

(2)在本条内,“颁发日期”指——

(a)凡关乎1949年《专利权法》所颁发之专利权者,则根据该法第19条所列之专利权获批准盖章之日期;

(b)凡关乎1977年《专利权法》所颁发之专利权者,则按照该法第25条所列之专利权生效日期;及

(c)凡关乎欧洲(英国)专利权者,则按照1977年《专利权法》第77条所列专利权在英国生效之日期。

4.连同申请书提交之有关文件

根据本条例提出之申请书须连同下列文件一起提交——

(a)假如该专利发明品说明书非用英文刊印,说明书认证英文译本1份;或

(b)在其他情况下,专利发明品说明书认证副本1份,

上述文件须连同专利发明品有关之绘图(如有)及局长证明书,列明颁发专利权及该说明书在英国生效之细则,一并提交。

5.发出注册证书

上述申请书连同第4条提及之文件,一经收妥,及申请人已缴付指定之注册费及任何指定刊登广告之费用,处长须发出注册证书。

6.注册授予之权利性质

除须遵守香港法例规定之一切条件外,上述注册证书将授予申请人特权及权利,一如该专利权在英国颁发而引伸至香港。

7.因注册而获授权利之期限

注册证书授予申请人之特权及权利,应由该有关之专利权在英国开始实施之日期起生效,只要该专利权在英国有效,该特权及权利即继续有效;

惟在香港发出该注册证书之前,任何因侵犯专利权之行为而提出之诉讼,概不受理。

7A.政府

除本条例及《官方诉讼条例》(第300章)第5条第(3)款另有规定外,在1968年《英国专利权注册(修订)条例》开始实施后,注册证书即在针对政府及市民时,有相同效力,不论该证书是否于该条例开始实施前或开始实施后发出者亦然。

7B使用专利发明品为政府服务

(1)(a)纵使本条例或任何其他法例另有规定,政府或获总督书面授权之任何人,可按本条下开规定使用任何专利发明品为政府服务。

(b)如某发明品已在英国获颁给专利权或其专利权已在英国生效,则为执行本条例之规定起见,根据本条例对该专利权发给注册证书后(但不得在任何较早时间),该发明品即成为专利发明品。该专利权在英国有效期间,该发明品即属专利发明品。但如有根据本条例作出之声明,谓该发明品并未获该证书所授予之专有特权及权利者,则该发明品不得为或被视为本条所指之专利发明品。

(2)如英国政府之任何部门或英国原子能管理局或香港政府并非因直接或间接获按照1977年《专利权法》设置之专利权登记册所记录之获得专利权人或拥有人、或授予该人所有权之任何人之知会,而在优先日期前正式登记或试验专利权发明品,或以英国政府或英国原子能管理局或香港政府之名义正式登记或试验该发明品,则按本条使用该发明品之人,毋须向根据本条例发出之有关注册证书而获授予特权及权利之人缴付专利权税或其他费用。

(3)如该专利发明品并未以上文所载之方式登记或试验,在根据本条例而对该发明品发出专利权注册证书后任何时间内,或因上文所载之任何知会而按本条规定使用该发明品,得在使用前或使用后,按政府与获注册证书授予特权及权利之人议定之条件办理,或如双方未能达成协议,则根据第7D条之规定,由法庭作出决定。

(4)在对专利发明品发出注册证书之前或之后,及在授权进行某些行为而在该等行为完成之前或之后,总督对该专利发明品拥有之权力可根据本条而授予任何人,不论该人有否直接或间接获得根据注册证书而享有特权及权利使用该发明品之人之授权。

(5)如香港政府或获总督授权之任何人以任何方式使用专利发明品,则按本条之规定,布政司于该发明品被开始使用后应尽快通知根据本条例发出之注册证书之持有人,并向该持有人提供其不时所需之资料,如该发明品被使用之范围等,惟总督如认为此举乃有违公众利益者,则属例外。

7C.第三者在政府使用发明品方面之权利

(1)在第7B条第(1)款(b)段意义范围以内,如下开人士以任何方式使用专利发明品为政府服务——

(a)政府或根据第7B条获总督授权之人;或

(b)根据注册证书而获授予特权及权利之人,依照政府之命令而进行者,

则无论在1968年《英国专利权注册(修订)条例》开始实施之前或之后,如根据注册证书而获授予特权及权利之人,或任何获该人授予专利权之人或授予该人专利权之人,与政府以外之任何人订立任何许可证、转让契约或协议,对该发明品,或与该发明品有关之任何模型、文件或资料之使用作出限制或规定,或对任何该等物品之使用费,或对视乎该等物品之使用范围而计算使用费之方法作出规定者,则其订立之条款均属无效。

(2)如非就专利权税或视发明品使用范围而定之其他权利而发出之专利许可证在本港有效,则——

(a)除本条及第7B条另有规定外,如有人以任何方式使用专利发明品,因而对专利许可证持有人之权利构成损害者,则第7B条第(3)款之规定即属适用,一如该款提及根据注册证书而获授予特权及权利之人,亦即专利许可证持有人一样;及

(b)如专利发明品为根据第7B条而获授权之专利许可证持有人所使用,第7B条之规定即属适用,一如上段提及之第(3)款已遭删除。

(3)除第(2)款另有规定外,如专利权已转让与根据注册证书而获授予特权及权利之人,而该转让乃由于专利权税或视乎专利发明品使用范围而定之其他权利而达成者,则——

(a)如有人根据第7B条以任何方式使用该发明品,第(3)款之规定即属适用,一如该款提及之根据注册证书而获授予特权及权利之人,包括该转让人在内。根据该款而应于缴付之任何数额,得由获授上述权利之人及转让人以其双方同意之比例分配,或如双方未能达成协议,则由法庭根据第7D条作出判决;及

(b)如根据注册证书而获授予特权及权利之人以任何方式使用该发明品为政府服务并依照政府之命令而进行者,第7B条第(3)款之规定即属适用,一如该人根据该条赋予之权力而使用该发明品无异。

(4)如根据第7B条第(3)款,政府因以任何方式使用某专利发明品,而须缴付费用予按注册证书而获授予特权及权利之人,则授权持有人以某方式使用该发明品而又在本港有效之专利许可证之持有人(并非本条第(2)款所述之许可证),有权向根据注册证书而获授予特权及权利之人收取政府缴付之部分费用(如有者),而该部分为该专利许可证持有人及获授上述特权及权利之人所同意者,或如双方未能达成协议,则由法庭于考虑该专利许可证持有人在下开任何用途方面之支出后,根据第7D条作出判决——

(a)制成该发明品;或

(b)因持有专利许可证而须向获授上述特权及权利之人缴付之费用,但专利权税或视乎发明品之使用范围而定之其他费用则除外。

在政府与获授上述特权及权利之人就任何付予专利许可证持有人之款额达成协议之前,如该专利许可证持有人以书面向布政司述明其权益,则除获该持有人同意外,任何有关该款额之协议均属无效。

7D.政府使用专利发明品引起之争执提交法院

(1)任何争执,与政府或总督授权之人士行使第7B条授予之权力有关,或与使用专利发明品服务政府之条件有关,或与任何人按照第7B条第(3)款收取款项任何部分之权力有关,其中一方当事人,可根据法庭规例指定之方式,交由最高法院原讼庭处理。

(2)根据本条,在任何律政司代表英国政府或香港政府之诉讼中,律政司可——

(a)若享有有关注册证书授予之特权及权利之人士为诉讼一方当事人,根据第8条发出声明之任何理由,申请一项声明,宣称该当事人未能取得注册证书授予之专有特权及权利;

(b)在任何情况下,毋须申请上述声明而提出研究该注册证书之有效性。

(3)在上述诉讼中,若怀疑发明品是否依据第7B条记录或试验,或总督认为公开任何记录该发明品之文件或其任何试验结果对公众利益有损害,则有关资料只可秘密知会另一方当事人之法律顾问,或一名经双方同意之独立专家。

(4)根据本条,法庭在审判政府与任何人之间,关于使用发明品服务政府之条件之争执时,得考虑该人或任何从该人处取得专利权之人,就该发明品,从政府直接或间接收取或有权收取之利益或赔偿。

(5)根据本条,在任何诉讼中,法庭于任何时间内可命令将整个诉讼,或任何问题,或其中出现之事实上争论,委托一特别审裁员或仲裁人根据法庭订明之条件处理;在本条前述之条款中,提交法庭处理,也得作相应解释。

8.宣称持有人未获得专有特权之权力

(1)任何人如提出申请,声称其利益受注册证书之发出所损害,根据目前英国生效之法律,最高法院原讼庭有权以任何撤销专利权或当作撤销专利权之理由,宣称专利权持有人并未获得注册证书授予之专有特权及权利。

(2)上述理由被视为包括,于该专利权在英国适用之优先日期前,该发明品已在香港境内制造、使用或售卖;但上述理由不包括,于该专利权在英国适用之优先日期后及根据第5条注册证书之发出日期前,该发明品在香港境内由某人或某些人制造、使用或售卖。

9.修改说明书或绘图

根据英国法例,若任何在香港注册之专利发明品说明书或其绘图已作修改,或当作修改处理,专利权持有人可向处长提出请求,以修改后之说明书及绘图代替最初存案之说明书及绘图。申请书得连同修改后之说明书副本及绘图(如有),或经局长正式认证之修改建议英文译本1份,一并提交。

10.转让等事项之注册

若任何人因转让、遗赠或由于其他法例运作而享有注册证书授予之特权及权利,或其中之利益,该人可循指定方式向处长申请,将此等影响专利权或赋予其中利益之转让、遗赠或其他法律文件,加入登记册内。

11.制订指示运作及缴费规则之权力

除须遵守本条例之规定外,处长可制订其认为合适之规则及采取其认为合适之行动,对本条例运作程序及所须缴付之诉讼费用作出指示;

但上述规则,须先由立法局通过及在宪报刊登,否则无效。

WHOLE DOCUMENT

1. Short titleThis Ordinance may be cited as the Registration of Patents Ordinance.(Amended 25 of 1979 s. 3)

2. InterpretationIn this Ordinance, unless the context otherwise requires--"comptroller" means the Comptroller-General of Patents, Designs and TradeMarks in the United Kingdom; (Added 25 of 1979 s. 4) [cf. 1977 c. 37 s.130 U. K.] "European patent (UK)" means a patent granted under theConvention on the Grant of European Patents and designating the UnitedKingdom; (Added 25 of 1979 s. 4) [cf. 1977 c. 37 s. 130 U. K.]"patent" means a patent granted under the Patents Act 1949 (1949c. 87 U.K.) or under the Patents Act 1977 (1977 c. 37 U. K.) and means also aEuropean patent (UK) that has effect in the United Kingdom pursuant tosection 77 of the Patents Act 1977 (1977 c. 37 U. K.); (Added 25 of 1979s. 4);"priority date" has the meaning assigned to it--

(a) in the case of a patent under the Patents Act 1949 (1949 c. 87 U. K.),by section 5 of that Act;

(b) in the case of a patent under the Patents Act 1977 (1977 c. 37 U. K.),by section 5 of that Act; and

(c) in the case of a European patent (UK), by section 5 of the Patents Act1977 (1977 c. 37 U. K.), subject to the incidents and modificationsmentioned in section 78 of that Act; (Added 25 of 1979 s. 4)"Registrar" means the Registrar of Patents appointed by the Governor.(Amended 35 of 1990 s. 9)(Replaced 27 of 1958 s. 2)

3. Application for registration of patent

(1) Any person being the grantee of a patent, or any person deriving hisright from such grantee by assignment, transmission or other operation oflaw, may, within 5 years from the date of grant of the patent, apply tohave such patent registered in Hong Kong. Where any partial assignment ortransmission has been made all proper parties shall be joined in theapplication for registration. (Amended 27 of 1958 s. 3; 25 of 1979 s. 5)

(2) In this section "the date of grant" means--

(a) in relation to a patent under the Patents Act 1949 (1949 c. 87 U. K.),the date of sealing of the patent under section 19 of that Act;

(b) in relation to a patent under the Patents Act 1977 (1977 c. 37 U. K.),the date upon which the patent takes effect pursuant to section 25 of thatAct; and

(c) in relation to a European patent (UK), the date upon which the patenttakes effect in the United Kingdom pursuant to section 77 of the PatentsAct 1977 (1977 c. 37 U. K.). (Added 25 of 1979 s. 5)

4. Application to be accompanied by certain documentsAn application under this Ordinance shall be accompanied by--

(a) in the case of a patent the specification of which was published in alanguage other than English, a certified copy of the translation intoEnglish of the specification; or

(b) in any other case, a certified copy of the specification, togetherwith the drawings (if any) relating to the patent and a certificate of thecomptroller giving full particulars of the grant of the patent or of itstaking effect in the United Kingdom on such specification.(Replaced 25 of 1979 s. 6)

5. Issue of certificate of registrationUpon such application being received, together with the documentsmentioned in section 4, and upon payment of the prescribed fees and of thecost of any prescribed advertisement, the Registrar shall issue acertificate of registration. (Amended 27 of 1958 s. 4)

6. Nature of rights conferred by registrationSuch certificate of registration shall confer on the applicant privilegesand rights, subject to all conditions established by the law of Hong Kong,as though the patent had been granted in the United Kingdom with anextension to Hong Kong. (Amended 25 of 1979 s. 7)

7. Period of rights conferred by registrationThe privileges and rights so granted shall date from the commencement ofthe term of the patent in the United Kingdom and shall continue in forceonly so long as the patent remains in force in the United Kingdom:Provided that no action for infringement shall be entertained in respectof any act done prior to the date of issue of the certificate ofregistration in Hong Kong. (Amended 25 of 1979 s. 8)

7A. CrownSubject to the provisions of this Ordinance and of section 5 (3) of theCrown Proceedings Ordinance (Cap. 300), a certificate of registration,whether issued before or after the commencement of the Registration ofUnited Kingdom Patents (Amendment) Ordinance 1968 (24 of 1968), shall,after the commencement of that Ordinance, have the same effect against theCrown as it has against a subject.(Added 24 of 1968 s. 2)[cf. 1949 c. 87 s. 21 (2) U. K.]

7B. Use of patented inventions for the services of the Crown

(1) (a) Notwithstanding anything in this Ordinance or any other law, theGovernment, and any person authorized in writing by the Governor, may useany patented invention for the services of the Crown in accordance withthe following provisions of this section.

(b) An invention for which a patent has been granted or has taken effectin the United Kingdom shall, upon the issue ofa certificate ofregistration of such patent under this Ordinance (but not any earlier)become a patented invention for the purposes of this section, and shallremain a patented invention only for so long as the patent remains inforce in the United Kingdom, save that if a declaration is made under thisOrdinance that the exclusive privileges and rights conferred by suchcertificate have not been acquired the invention shall not be or beregarded as having been a patented invention within the meaning of thissection. (Amended 25 of 1979 s. 9)

(2) If and so far as the patented invention has before its priority datebeen duly recorded by or tried by or on behalf of any department of HerMajesty's Government in the United Kingdom or the United Kingdom AtomicEnergy Authority or the Government otherwise than in consequence of thecommunication thereof directly or indirectly by the person or personsentered as grantee or proprietor of the patent on the register of patentskept pursuant to the Patents Act 1977 (1977 c. 37 U. K.)or by any personfrom whom he derives title, any use of the invention by virtue of thissection may be made free of any royalty or other payment to the personentitled under the relevant certificate of registration issued under thisOrdinance to the privileges and rights conferred by such certificate.(Amended 25 of 1979 s. 9)

(3) If and so far as the patented invention has not been so recorded ortried as aforesaid, any use of the invention made by virtue of thissection at any time after the issue under this Ordinance of thecertificate of registration of the patent granted for that invention, orin consequence of any such communication as aforesaid, shall be made uponsuch terms as may be agreed upon, either before or after the use, betweenthe Government and the person entitled under the certificate ofregistration to the privileges and rights conferred thereby, or as may indefault of agreement be determined by the court on a reference undersection 7D.

(4) The authority of the Governor in respect of a patented invention maybe given under this section either before or after the certificate ofregistration of the patent for the invention is issued and eitherbeforeor after the acts in respect of which the authority is given are done, andmay be given to any person whether or not he is authorized directly orindirectly by the person entitled under the certificate of registration tothe privileges and rights conferred thereby to use the invention.

(5) Where any use of a patented invention is made by the Government, or byany person with the authority of the Governor, under this section, then,unless it appearsto the Governor that it would be contrary to the publicinterest so to do, the Chief Secretary shall notify the holder of thecertificate of registration issued under this Ordinance as soon as ispracticable after the use is begun, and furnish him with such informationas to the extent of the useas he may from time to time require.(Added 24 of 1968 s. 2)[cf. 1949 c. 87 s. 46 (1), (2), (3), (4), (5)

7C.Right of third parties in respect of Crown use

(1) In relation to any use of a patented invention, within the meaning ofsection 7B (1) (b), made for the services of the Crown--

(a) by the Government, or by a person authorized by the Governor undersection 7B; or

(b) by the person entitled under the certificate of registration to theprivileges and rights conferred thereby, to the order of the Government,the provisions of any licence, assignment or agreement made, whetherbefore or after the commencement of the Registration of United KingdomPatents (Amendment) Ordinance 1968 (24of 1968), between the personentitled under the certificate of registration to the privileges andrights conferred thereby, or any person who derives title from him or fromwhom he derives title, and any person other than the Government shall beof no effect so far as those provisions restrict orregulate the use ofthe invention, or any model, document or information relating thereto, orprovide for the making of payments in respect of any such use, orcalculated by reference thereto.

(2) Where an exclusive licence granted otherwise than for royalties orother benefits determined by reference to the use of the invention is inforce in the Colony, then--

(a) in relation to any use of the patented invention which, but for theprovisions of this section and section 7B, would constitute aninfringement of the rights of the licensee, section 7B(3) shall have effect as if for thereference to the person entitled underthe certificate of registration to the privileges and rights conferredthereby there were substituted a reference to the licensee; and

(b) in relation to the use of the patented invention by the licensee byvirtue of an authority given under section 7B, that section shall haveeffect as if the said subsection (3) were omitted.

(3) Subject to the provisions of subsection (2), where the patent has beenassigned tothe person entitled under the certificate of registrationthereof to the privileges and rights conferred by such certificate inconsideration ofroyalties or other benefits determined by reference tothe use of the patented invention, then--

(a) in relation to any use of the invention by virtue of section 7B,subsection (3) of that section shall have effect as if the reference tothe person entitled under the certificate of registration to theprivileges and rights conferred thereby included a reference to theassignor, and any sum payable by virtue of that subsection shall bedivided between the person entitled as aforesaid and the assignor in suchproportion as may be agreed upon between them or as may in default ofagreement be determined by the court on a reference under section 7D; and

(b) in relation to any use of the invention made for the services of theCrown by the person entitled under the certificate of registration to theprivileges and rights conferred thereby to the order of the Government,section7B (3) shall have effect as if that use were made by virtue of anauthority given under that section.

(4) Where, under section 7B (3), payments are required to be made by theGovernment to a person entitled under a certificate of registration to theprivileges and rights conferred thereby in respect of any use of patentedinvention, any person, being the holder of an exclusive licence in forcein the Colony (not being such a licence as is mentioned in subsection (2)of this section) authorizing him to make that use of the invention, shallbe entitled to recover from the person entitled under the certificate ofregistration to the privileges and rights conferred thereby such part (ifany) of thosepayments as may be agreed upon between that person and theperson entitled as aforesaid to the said privileges and rights, or as mayin default of agreement be determined by the court under section 7D to bejust having regard to any expenditure incurred by that person--

(a) in developing the said invention; or

(b) in making payments to the person entitled as aforesaid to the saidprivileges and rights, other than royalties or other payments determinedby reference to the use of the invention, in consideration of the licence,and if, at any time before the amount of any such payment has been agreeduponbetween the Government and the person entitled as aforesaid to thesaid privileges and rights that person gives notice in writing of hisinterest to the Chief Secretary, any agreement as to the amount of thatpayment shall be of no effect unless it is made with his consent.(Added 24 of 1968 s. 2)[cf. 1949 c. 87 s. 47 U. 7D. Reference of disputes as to Crown use

(1) Any dispute as to the exercise by the Government or a personauthorizedby the Governor of the powers conferred by section 7B, or as toterms for the use of a patented invention for the services of the Crownthereunder, or as to the right of any person to receive any part of apayment made in pursuance of subsection (3) of that section, may bereferred to the HighCourt by either party to the dispute in such manneras may be prescribed by rules of court.

(2) In any proceedings under this section in which the Attorney Generalrepresents the Crown or the Government, the Attorney General may--

(a) if the person entitled under the relevant certificate of registrationto the privileges and rights conferred thereby is a party to theproceedings, apply for a declaration, on any of grounds upon which such adeclaration may be made under section 8, that the exclusive privileges andrights conferred by such certificate of registration have not beenacquired;

(b) in any case, put in issue the validity of the certificate withoutapplying for such a declaration as aforesaid.

(3) If in such proceedings as aforesaid any question arises whether aninvention has been recorded or tried as mentioned in section 7B, and thedisclosure of any document recording the invention, or of any evidence ofthe trial thereof, would in the opinion of the Governor be prejudicial tothe public interest, the disclosure may be made confidentially to counselfor the other party or to an independent expert mutually agreed upon.

(4) In determining under this section any dispute between the Governmentand any person as to terms for the use of an invention for the services ofthe Crown, the court shall have regard to any benefit or compensationwhich that person or any person from whom he derives title may havereceived, or may be entitled to receive, directly or indirectlyfrom theGovernment in respect of the invention in question.

(5) In any proceedings under this section the court may at any time orderthe whole proceedings or any question or issue of fact arising therein tobe referred to a special referee or an arbitrator on such terms as thecourt may direct; and references to the court in the foregoing provisionsof this section shall be construed accordingly. 8. Power to declare exclusive privileges not acquired

(1) The High Court shall have power, upon the application of any personwho alleges that his interests have been prejudicially affected by theissue of a certificate of registration, to declare, on any of the groundsupon which the patent might be revoked or treated as revoked under the lawfor the time being in force in the United Kingdom, that the exclusiveprivileges and rights conferred by such certificate of registration havenot been acquired. (Amended 25 of 1979 s. 10)

(2) Such grounds shall be deemed to include the manufacture, use or saleof the invention in the Colony before the priority date applicable to thepatent in the United Kingdom, but not to include the manufacture, use orsale of the invention in the Colony by some person or persons after thepriority date applicable to the patent in the United Kingdom and beforethe date of the issue of the certificate of registration under section 5.(Replaced 27 of 1958 s. 5. 9. Amendment of specification or drawingsWhenever the specification or drawings of a patent registered in Hong Konghas or have been amended or treated as amended, according to the law ofthe United Kingdom, a request, accompanied by a copy of the specificationand drawings (if any) as amended, or a copy of the translation intoEnglish of the amendment, as the case may be, duly certified by thecomptroller, may be made to the Registrar to substitute the specificationand drawings as amended for the specification and drawings originallyfiled.(Replaced 25 of 1979 s. 11)

10. Registration of assignment, etc.Where a person becomes entitled by assignment, transmission or otheroperation of law to the privileges and rights conferred by a certificateof registration or to any interest therein, he may make application in theprescribed manner to the Registrar for the entry on the register of suchassignment, transmission or other instrument affecting the title, orgiving an interest therein.(Amended 27 of 1958 s. 4)

11. Power to make rules prescribing procedure and feesThe Registrar may make such rules and do such things as he may thinkexpedient, subject to the provisions of this Ordinance, for prescribingthe procedure under this Ordinance and the fees to be paid in respect ofproceedings under this Ordinance: Provided that no such rules shall comeintooperation until the same have been approved by the LegislativeCouncil and published in the Gazette.
